Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and BAO ADVERTISING LLC ("FinanceToad," "we," "us," or "our") and govern your access to and use of FinanceToad.com and our services (the "Site"). Please read them carefully, including the arbitration agreement and class-action waiver below.

Acceptance of These Terms

By accessing or using the Site, submitting a form, or otherwise interacting with us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old and a resident of the United States with the legal capacity to enter into contracts to use the Site. By using the Site, you represent that you meet these requirements.

Important Notice — FinanceToad Is Not a Lender

FinanceToad is not a lender, bank, loan broker, or financial institution. We do not make credit decisions, originate loans, set rates, fund, or service any financial product. We do not provide financial, tax, investment, or legal advice. Nothing on the Site is a commitment to lend or an offer of any financial product. We do not guarantee approval, eligibility, rates, terms, amounts, or any particular result. Any rates or offers displayed are illustrative only, and actual offers come solely from third-party providers based on their own criteria.

Description of the Service

FinanceToad is an independent, advertising-supported comparison and education resource and lead-generation service. We:

  • Provide educational content and comparison tools about financing options.
  • Collect information you submit and use it to match you with, and refer you to, third-party lenders, financing companies, advertisers, and marketing partners ("Partners").
  • May share or sell your information to Partners who may contact you, as described in our Privacy Policy.

We earn compensation when you connect with Partners. See our Advertiser Disclosure.

Your Responsibilities and Accuracy of Information

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for the information you submit and for evaluating any Partner offer independently. You agree not to submit information about another person without authorization, and not to use the Site for any unlawful purpose.

Consent to Be Contacted — TCPA and Marketing

When you submit a form on the Site, you may be asked to provide express written consent authorizing FinanceToad and our Partners to contact you at the phone number and email you provide — including by automatic telephone dialing system, prerecorded or artificial voice, and text message — about financing offers and related products, even if your number is on a state or federal Do Not Call list.

  • Consent is not a condition of any purchase or of using the Site.
  • Message and data rates may apply; message frequency varies.
  • Reply STOP to opt out of text messages from us, and HELP for help. To stop communications from a Partner, you must contact that Partner directly.

This consent is in addition to, and does not limit, the disclosures in our Privacy Policy.

The Site contains links to and connections with Partners and other third parties. We do not control, endorse, guarantee, or assume responsibility for any Partner, their products, services, rates, terms, websites, or privacy and security practices. Any dealings, transactions, or agreements between you and a Partner are solely between you and that Partner. You should review all Partner terms and disclosures before accepting any product.

Intellectual Property and Trademarks

The Site and its content — including text, graphics, logos, the FinanceToad name, the toad logo, and design — are owned by or licensed to FinanceToad and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, scrape, or create derivative works without our prior written permission. "FinanceToad" and our logo are our trademarks and may not be used without authorization.

Acceptable Use and Prohibited Conduct

You agree not to:

  • Violate any law or the rights of others.
  • Submit false, misleading, or fraudulent information.
  • Use bots, scrapers, or automated means to access or collect data from the Site.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems.
  • Introduce malware or attempt to circumvent security features.
  • Use the Site to send spam or harvest information about others.
  • Reverse engineer or copy any part of the Site except as permitted by law.

Disclaimers of Warranties

THE SITE AND ALL CONTENT, TOOLS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure, or that any information, rates, or offers are accurate, complete, or current. You use the Site at your own risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FINANCETOAD AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PARTNER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER THEORY. Our total aggregate liability for any claim relating to the Site will not exceed $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless FinanceToad and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law or third-party right, or any information you submit.

Binding Arbitration and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

You and FinanceToad agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court. Arbitration will be administered by the American Arbitration Association under its applicable rules, and judgment on the award may be entered in any court with jurisdiction.

Class-action waiver. You and FinanceToad agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Opt-out. You may opt out of this arbitration agreement by sending written notice to privacy@financetoad.com within 30 days of first accepting these Terms, stating your name and intent to opt out. If you opt out, the remaining Terms still apply.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the arbitration provisions. Subject to the arbitration agreement, any disputes not subject to arbitration will be brought in the state or federal courts located in New Jersey.

Severability

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.

Changes to These Terms

We may modify these Terms at any time by posting the updated version and revising the "updated" date above. Your continued use of the Site after changes take effect constitutes acceptance. If you do not agree to the changes, stop using the Site.
